Everyone’s talking about…
Given the growing relevance of ESG, the Netherlands has emerged as a particularly attractive jurisdiction for claims, especially due to its sophisticated class action system, which enables interest organizations to bring forward ESG-related cases. Landmark rulings – such as Urgenda v Netherlands and Milieudefensie v Shell – have drawn widespread attention. Specific sectors are being targeted, including airlines, the financial industry and companies with extensive supply chains (eg clothing and food businesses). In essence, any company can be targeted. The growing threat of ESG litigation, liability risks, and regulatory scrutiny has even led to the emergence of anti-ESG movements; companies that adopt a more resistant stance toward ESG. ESG litigation is a rapidly evolving field, especially in the Netherlands, and we expect its relevance to increase in the coming years.
It is about finding a balance between all stakeholders. For me, that is what makes the job both fun and meaningful, especially when working with an enthusiastic team. Pleading a case in court, particularly when ESG issues are involved, is both exciting and challenging.
If I wasn’t a lawyer, I would probably be…
A comedian or writer of children’s books. When I was younger, I liked making up stories and writing them down, including handmade drawings, and to perform for family and friends. That is also what I like about being a litigation lawyer, writing court documents and putting the client’s story on paper to present to the court.

Marit Bosselaar is a rising force in dispute resolution at Loyens & Loeff’s Amsterdam office, with a sharp focus on class actions and commercial litigation, particularly in the financial and ESG domains. Her standout work includes representing car dealers in Dutch class actions over diesel emissions, a public utilities company in a human rights-related class action, and the former CEO of Airbus SE in shareholder litigation.
Marit is deeply engaged in ESG litigation, advising clients on liability and regulatory risks. She recently guided a multinational through the implications of anti-greenwashing legislation in Europe and the Netherlands and has provided expert commentary on the EU’s proposed ‘Green Claims’ Directive. Her thought leadership extends to regular publications in legal journals and speaking engagements, including the ESG Litigation Summit.
Beyond her client work, Marit contributes to ESG initiatives through Loyens & Loeff’s firm-wide ESG focus group and pro bono efforts, as highlighted in the firm’s 2024 CSR Report.
